Employee-side employment attorney helping workers—one of the few in Texas focused on fighting for employees.

When your job, paycheck, reputation, or future is on the line, you need clear answers and a practical plan. I’m Joel Smith, a Texas employment attorney based in the Houston area, and my practice focuses on helping employees understand and protect their rights in the workplace.
I represent workers in matters involving wrongful termination, workplace discrimination, retaliation, harassment, disability accommodations, unpaid wages, severance agreements, employment contracts, and other employee-side employment disputes. I am licensed to practice law in the State of Texas and admitted to practice before the United States Court of Appeals for the Fifth Circuit and the United States District Court for the Southern District of Texas.
Not every unfair workplace decision is illegal—but many terminations, demotions, pay issues, and workplace actions deserve a serious legal review. If you were fired, pushed out, denied accommodations, retaliated against, or treated differently because of a protected characteristic, I can help you evaluate what happened, what deadlines may apply, and what options you have.
I help employees with workplace legal issues such as:
Wrongful Termination
If you were fired for an unlawful reason—or after reporting illegal conduct, discrimination, harassment, wage issues, or requesting protected rights—I can help you determine whether you may have a claim.
Workplace Discrimination
I review claims involving discrimination based on race, color, sex, pregnancy, religion, national origin, disability, age, and other protected categories under federal and Texas law.
Retaliation
Employees should not be punished for reporting discrimination, requesting accommodations, raising wage concerns, participating in an investigation, or asserting legally protected rights.
Disability Accommodation & ADA Issues
If your employer ignored, denied, delayed, or mishandled a reasonable accommodation request, I can help you understand the interactive process and your legal options.
Harassment & Hostile Work Environment
I help employees evaluate whether workplace conduct crosses the line from unfair or offensive behavior into legally actionable harassment.
Wage, Overtime & Pay Disputes
If you were not paid for all hours worked, denied overtime, misclassified, or pressured to work off the clock, I can help you assess your options.
Severance Agreements & Employment Contracts
Before you sign a severance agreement, release, noncompete, employment contract, or settlement agreement, I can review the terms, explain the risks, and help negotiate where appropriate.
Before opening my private law practice, I spent 21+ years with the Social Security Administration as a Claims Specialist, Technical Expert, Supervisor, and trainer of SSA employees. That experience taught me how complex systems work, how decision-makers evaluate evidence, and how important it is for clients to understand the process in plain English.
I also bring the perspective of someone who has worked full-time, led as a union president, taught others, and navigated demanding professional responsibilities while building a legal career. I graduated third in my law school class while working full-time, serving as a union president, and maintaining my family commitments. That same discipline, preparation, and client-first work ethic guides my representation today.
Employment disputes are stressful. Clients often come to me after being fired, threatened, ignored, or pressured to sign something they do not fully understand. My approach is direct:
I listen to what happened.
I review the documents.
I identify the legal issues.
I explain your options in plain English.
I help you decide on a strategy that fits your goals, timeline, and budget.
You will not get empty promises or legal jargon. You will get candid advice, careful preparation, and a plan you can understand.
Although my webpage now emphasizes employment law, my background with SSA remains an important advantage for clients dealing with complex government systems.
For Social Security Disability Insurance and SSI disability claims, I offer consultations for individuals seeking disability benefits. We can discuss eligibility, medical evidence, vocational issues, appeals timelines, and filing strategy.
For retirement and survivor benefit questions, I provide one-on-one educational consultations to help clients understand claiming age, delayed credits, spousal and surviving-spouse benefits, and how work or pensions may affect benefit decisions. These consultations are educational and do not involve representation in retirement or survivor benefit matters.
Employment disputes often involve documents: offer letters, handbooks, severance agreements, releases, settlement terms, contractor agreements, vendor agreements, and restrictive covenants. I help clients understand what these documents mean before they sign—or before a disagreement escalates.
Clear contract advice can prevent costly mistakes.
I teach and have taught law school students, including Legal Skills, Advanced Legal Skills, Bar Preparation, and Legal Studies. Teaching keeps my writing, analysis, and explanations sharp. Clients benefit from clear communication, structured thinking, and practical legal strategy.
